Managing agents fined for unlicensed HMOs. In 2024, Haringey Council issued over £108,000 in penalties to landlords and letting agents for HMO licensing failures. Managing agents were fined up to £15,000 per property and listed on the GLA Rogue Landlord and Agent Checker. From 1 May 2026, the maximum civil penalty per offence is £40,000.
Agents must serve the RRA Information Sheet. Under the Renters’ Rights Act 2025, where a property is managed by a letting agent, the agent must provide the Information Sheet to the tenant, even if the landlord has already done so. Failure to comply may result in a fine of up to £7,000 per tenancy. The deadline for existing tenancies was 31 May 2026.
Using outdated possession notice forms invalidates proceedings. SI 2026/354 prescribes new mandatory forms for Section 8 and Section 13 notices from 1 May 2026. Any agent serving a pre-May 2026 template on a new assured periodic tenancy risks the notice being struck out, the proceedings failing, and the landlord client losing months. The liability sits with whoever served the notice.
