Rent increases limited to once per year via Section 13 notice from 1 May 2026

From 1 May 2026, landlords in England can only increase rent once per year, using the Section 13 notice process with at least two months' notice. Increases are capped at market rent. Tenants can challenge unfair rent increases at the First-tier Tribunal without the risk of a higher rent being imposed than the landlord originally requested.

The Tribunal can no longer set a higher rent than the landlord requested, removing a deterrent that previously discouraged tenants from challenging increases.

Increases are not backdated and limited deferrals may be granted in hardship cases.

Action required

Review your rent increase schedule. Ensure all future increases follow the Section 13 process. Hidden or confusing rent increase terms in tenancy agreements are no longer enforceable.
